BlinkCart Terms of Service

By using the BlinkCart Site (blinkcart.com) and its related services ("Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). If you do not agree to these Terms of Service or any part thereof, your only remedy is to not use the BlinkCart web site. Violation of any of the terms below will result in the termination of your Account and the right to use the blinkcart.com web site. You agree to use the BlinkCart Site at your own risk

Your Responsibility

• You are responsible for any activity that occurs under your account.
• You are responsible for keeping your password secure.
• You may not use this "Service" for any illegal purposes or violate any laws in your jurisdiction.
• You are solely responsible for any data, text, information, graphics, links (“Content”) that you submit, post, and display on blinkcart.com.

Payment, Refunds, Upgrading and Downgrading Terms

• A credit card is not required to create or use a free 7 day trial account.
• We will charge you a standard monthly fee based on your account type. The Service is billed in advance for each month, and is non-refundable. There will be no refunds or credits for partial months of service, or refunds made should you not use the Service during a period of time when your account is open. No exceptions will be made.
• Should you upgrade or downgrade your account type, your credit card via Paypal will be charged your new billing rate immediately.
• All fees are exclusive of all taxes or duties imposed by governing authorities. You alone are responsible for payment of all such taxes or duties.
  

Cancellation & Termination

• You alone are responsible for the proper cancellation of your account. You may cancel your account at any time by clicking on the Account link in the Service's navigation menu. The Account screen provides a simple link to cancel your account.
• All of your Content will be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is cancelled.
• You can cancel at any time, but you will remain liable for all charges accrued up to that time, including full monthly charges for the month which you discontinued service. You will not be charged again.
• BlinkCart reserves the right to modify, suspend, or terminate your account at any time for any reason without notice. BlinkCart may refuse service to anyone for any reason at any time.

Modification to Services & Prices

• BlinkCart reserves the right to modify, suspend, or discontinue the Service at any time for any reason with or without notice.
• Prices of all Services, including but not limited to monthly subscription plan fees to the BlinkCart Site, are subject to change upon 30 days notice from us. Such notice may be provided at any time by posting the changes to the BlinkCart Site (http://www.blinkcart.com).

Copyright and Content Ownership

• We claim no intellectual property rights over the material you provide to the BlinkCart Site. However, by publishing your shopping cart, you agree to allow others to view and share the Content.

Disclaimer of Warranties

• Your use of this Service, including any content, information or functionality contained within it, is provided "as is" and "as available" with no representations or warranties of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. You assume total responsibility and risk for your use of this Service.
• BlinkCart does not warrant that
  
  
  1. The Service will meet your specific requirements or expectations
  2. The Service will be uninterrupted, timely, secure or error-free
  3. The results that may be obtained from the use of the Service will be accurate or reliable
  4. Any errors or bugs will be corrected.
     
     
• BlinkCart is neither responsible nor liable for any direct, indirect, incidental, consequential, special, exemplary, punitive or other damages arising out of or relating in any way to your use of the Service. Your sole remedy for dissatisfaction with the Service is to stop using the Service.
• Technical support is only provided to paying account holders and is only available via email. We will use commercially reasonable efforts to respond within a reasonable amount of time during regular business hours.
  

Changes to these Terms of Use

BlinkCart may modify these Terms of Service at any time without providing notice to you. Your continued use of the site after such a modification constitutes your acceptance of that modification. For this reason we provide a link to the Terms of Use at the bottom of every page — you should check them each time you visit, because you are bound by them if you use the site.
